Terms and conditions

These terms cover your use of this website. The contract for building your garden room is the written quote and terms we agree with you before work starts, and where the two differ, your quote takes precedence.

What these terms cover

These terms govern your use of this website. By using the site you accept them. If you do not accept them, please do not use the site.

They are not the contract for building a garden room. That contract is the written quote and accompanying terms we agree with you before any work starts. If anything here conflicts with your signed quote, your quote wins.

We may update these terms. The version published here at the time you use the site is the one that applies.

Using this website

You may use this site to look at our work and to contact us about a project. You agree not to:

  • use it in any unlawful or fraudulent way
  • attempt to gain unauthorised access to it, or to any server or database connected to it
  • introduce viruses or any other harmful material
  • copy, scrape or republish its content for your own commercial purposes

We may suspend or withdraw the site at any time. We do not guarantee it will always be available or free of errors.

Our content, and your rights to it

We own or are licensed to use the text, photographs, drawings and designs on this site. They are protected by copyright.

You may view and print pages for your own use in considering a project with us. You may not reuse, republish or adapt them elsewhere without our written permission.

Photographs show rooms we have built. Your room will differ according to your garden, the design agreed and the materials chosen.

Information on this site is not a quotation

Sizes, timescales, specifications and any figures shown on this site are typical examples given in good faith, not an offer or a quotation.

The price, specification and programme for your project are confirmed only in the written quote we issue after visiting your garden and measuring up. Until you accept that quote in writing, there is no contract between us.

Enquiries and quotes

Sending an enquiry through this site does not create a contract. It is an invitation for us to get in touch.

We give a free consultation of around thirty minutes, and follow up with a 3D visual and a fixed written quote. A quote is an offer on the terms written in it, and it only becomes a contract once you accept it in writing.

If you are a consumer

Nothing on this site affects your statutory rights. In particular:

Under the Consumer Rights Act 2015, we must carry out our services with reasonable care and skill, and any goods supplied must be of satisfactory quality, fit for purpose and as described.

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, where a contract is agreed in your home or elsewhere away from our business premises, you normally have 14 days to cancel from the day the contract is made. If you ask us in writing to begin work within that period, and we do, you may be asked to pay for what has already been done if you then cancel. Bespoke items made to your specification may be excluded from cancellation once made. The full cancellation terms, including how to cancel, are set out in your quote pack.

Guarantees

Our structural guarantee and the electrical certificate issued on completion are described elsewhere on this site in summary form only.

The guarantee that applies to your build, including what it covers, what it excludes and how long it runs, is the one stated in your written contract. Guarantees are in addition to your statutory rights, not instead of them.

Planning permission and permissions

Most garden rooms fall under permitted development, but not all. Responsibility for obtaining any planning permission, building regulations approval, listed building or conservation area consent, or the consent of a freeholder or neighbour, rests with you as the property owner, unless we agree otherwise in writing.

We will tell you what we know from experience, but that is guidance, not a legal determination. If you are unsure, check with your local planning authority.

Insurance

We are fully insured. Details of our cover can be provided on request before work begins.

Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for any loss arising from your reliance on the general information published on this website, as distinct from the written quote and contract for your project.

If you are a business rather than a consumer, we are not liable to you for loss of profit, loss of business, business interruption or loss of business opportunity arising from use of this site.

Links to other websites

Where this site links to another website, that link is for information only. We do not control those sites and are not responsible for their content.

Complaints

If something is not right, please tell us. Email sales@eleventrees.co.uk or call 0208 798 2610 and we will look into it.

If we cannot resolve a complaint between us, you can get free, independent advice from Citizens Advice at citizensadvice.org.uk.

Governing law

These terms and any dispute arising from them are governed by the law of England and Wales, and are subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer living elsewhere in the UK, you may also bring proceedings in your own local courts.

Changes to these terms

We may revise these terms from time to time. Please check this page for the current version. The date at the top shows when it was last changed.
